Against the backdrop of the protests in Warngau, the Holzkirchner local council discussed the planned asylum accommodation in Warngau under police protection - and sent a strong democratic signal with its vote.

Holzkirchen - Actually it was a technical matter: The district office had applied for the allocation of 520 so-called population equivalents (EGW) in order to connect the refugee accommodation planned on the district's own VIVO site to the Holzkirchen sewage treatment plant.

But another question overshadowed the debate: Do you want asylum accommodation for 500 people so close to Holzkirchen?

The legal situation

As Beate Faus, lawyer and head of the task force at the district office, explained when asked, Holzkirchen did not have to decide about the accommodation on Warngauer Flur, but rather about the

capacity of the sewage treatment plant

.

“This decision must be made appropriately.

Otherwise it can be legally challenged.” An expert from the Holzkirchen municipal utility had previously come to the conclusion that the allocation of capacities was possible from a technical point of view.

In the event of an improper rejection by the local council, the district office would

not

have taken legal action because they wanted to work with each other and not against each other, said Faus.

A different treatment technology would then have been implemented, such as a mini sewage treatment plant or underground collection tanks.

“We are happy and grateful about the decision of the Holzkirchner local council.

We can only meet the challenge by agreement.”

But asylum accommodation is not a done deal:

according to Faus, the Ministry of the Interior prefers longer-term accommodation for economic reasons.

The district office wants to limit the accommodation to 24 months.

According to Löwis, it has “decentralized solutions in the pipeline” that could be ready for decision in two years.

The district office is currently negotiating the time limit with the government of Upper Bavaria.

If the government commits to 24 months, construction will begin.

Otherwise not.

District Administrator Olaf von Löwis (CSU), who came to the meeting with the head of the task force, Beate Faus, appealed: “I ask for appropriate objections.” The community is not responsible for voting for or against asylum accommodation (see box).

However, Mayor Christoph Schmid (CSU) emphasized that a differentiated discussion was necessary in view of the consequences of the decision.

Given the impact of the meeting in Warngau the day before, the police had positioned themselves at the entrance to the meeting room as a precaution.

Schmid also made it clear right at the beginning of the meeting that he would expel anyone from the room who did not adhere to democratic customs, if necessary with the help of the police.

As is well known, citizens have no right to speak in local council meetings.

Nevertheless, there were heckling in the packed hall - until Schmid kicked out a visitor who repeatedly disrupted the council debate with his protest against the accommodation.

“You are representatives of the citizens, not the authorities!” the man shouted angrily as he left the hall.

Robert Wiechmann (Greens) had previously said: “We have no objective reason to prevent the authorities from fulfilling their duty, in this case the accommodation of refugees.” The majority of the local council voted for a special-purpose EGW limited to 24 months. Allocation for accommodation.

That's what the district administrator says

Before the vote, Löwis urged support.

“Those who are politically persecuted enjoy the right to asylum.

This is in our Basic Law and we have to respect the Basic Law.

“Every one of us.” He explained that districts are obliged to comply with the Königstein Key when it comes to accommodation.

But the district is far from doing that.

He is bottom in Upper Bavaria.

“That’s good!” shouted one from the audience.

Löwis was not deterred.

Accommodation in the gyms in Tegernsee and Miesbach is no longer acceptable given the restrictions for students, sports clubs and refugees.

“We have a damn duty to stand together in solidarity.”

The FWG parliamentary group voted against the allocation: “We showed solidarity with the Moarhölzl and installed a group of helpers.

We can’t manage another 500,” said Birgit Eibl.

She feared that the Hoki bus would reach its limits.

The Hoki is intended to ensure the connection to the asylum accommodation.

Moritz Remuta (Greens) countered: “With the expansion to Valley, Warngau and Otterfing, we have gained 10,000 passengers.

Saying that we can't do 500 stirs up fears that we don't need.” The Greens voted for the EGW allocation.

Likewise Dirk Kreder (FDP) and the SPD parliamentary group.

Simon Ammer: “The district depends on our help.

But we see it as temporary emergency aid.”

Schmid: “We will experience that there will be difficulties with accommodation.
