Lawyer Jorge Monasterky
denounced the CGT leader Pablo Moyano for threats and incitement to violence
due to the statements he made this Wednesday at the event in front of Congress against the DNU and the omnibus law.
In his speech, the trucker unionist warned the Minister of Economy Luis “Toto” Caputo that
“if he carries out these measures, the workers will throw him into the Riachuelo
.”
The complaint
will be drawn tomorrow by the Federal Chamber of Buenos Aires so that a judge and a prosecutor can be assigned.
“A few days ago the President, in a cheerful manner with a journalist, laughing, said that the Minister of Economy, due to the measures he was taking, must be carried away.
The same Minister of Economy, who was a partner of Macri, who fled 45,000 million dollars, who should be parading through the courts giving an explanation,” said Pablo Moyano.
And then he threatened him, “I tell you that if you carry out these economic measures of adjustment, hunger, and layoffs, the workers, the retirees, and
the most humble are going to take you on a litter to the Minister of Economy but to throw you into the stream
.”
Even the financier Javier Timerman - son of the founder of the newspaper La Opinión Jacobo Timerman - said that "
it is shocking to hear a union leader threaten to throw Luis Caputo into the Riachuelo
. Without words. There is no place for those sayings for democracy."
Caputo responded to Timerman and said "thank you Javier.
I hope that Justice takes action on the matter
."
This first complaint against Moyano complicates the situation of Hugo Moyano's son
who is accused in the case of fraud against Independiente.
At the end of last year, prosecutor Sebastián Scalera
appealed the second dismissal of trade unionist Pablo Moyano
in the Independiente fraud case.
In the appeal, he pointed out a series of “information errors and legal contradictions” by the guarantee judge Brenda Madrid in the dismissal of the Camioneros leader.
In a 140-page resolution, the head of the Complex Crimes Unit of Lomas de Zamora, took one by one the most controversial concepts of the magistrate and, at his discretion, refuted them.
The appeal states that the judge of Guarantees 1 of Avellaneda “
has
ostensibly violated the constitutional guarantee that ensures due legal process.”
And furthermore, “her decision is in contrast not only with the records in the file but with other previous pronouncements made by the Magistrate herself and the Court.”
“It is noted throughout the resolution that issues of typical adequacy, verification of the illicit act and authorship are mixed and confused,” Scalera added.
Then the question was asked: "In the ruling (of the judge) is it considered proven or not, that among the activities of the illicit association is that of "obtaining economic and/or institutional political benefits within the Club Atlético Independiente to position itself and remain in control of the institution, through a system of concessions and reciprocal and joint actions between club authorities and “barrabravas”?”
For the prosecutor, the leadership that “Pablo Hugo Antonio Moyano (alias) Salvaje
has maintained with the rest of the accused members of the criminal organization” who are already in oral trial
was evident .
The prosecutor rejected the judge's refusal to maintain that Pablo Moyano did not meet with Bebote Alvarez to negotiate that agreement.
“Clearly the meetings between Pablo Alvarez (alias) Bebote and Pablo Moyano have had the sole objective of destabilizing Javier Cantero (the former president of Independiente) to force his resignation.”
The judge maintained that in "the buses that she sent to carry out the protests to the country of Cantero, I do not find any crime because, according to what was stated by the declarant, they were schoolchildren from the Truckers' Union and this was prior to the inauguration of Pablo Moyano in the leadership of the Club.”
Judicial sources told
Clarín
that Room II of the Lomas de Zamora chamber, made up of Alejandro Rojas and Pablo Little, paralyzed the process "
until the situation of Yoyo Maldonado
, who benefited from the controversial annulment of his elevation to trial, is resolved."
by the Court of Cassation".
And the referral to the court of guarantees so that the request for elevation to the judgment of prosecutor Scalera can be resolved again.
But there is still no resolution and Moyano's dismissal is not final.
An extraordinary appeal was filed against the Cassation ruling before the Buenos Aires Supreme Court, which was declared inadmissible.
A complaint was filed against this before the Buenos Aires court.
As the annulment of the elevation to Maldonado's judgment is not yet final, the guarantee court has not yet issued a ruling and years pass
without Pablo Moyano's procedural situation being decided.
"Bebote" Alvarez and other defendants in this case are in the oral trial stage.
