The Petah Tikva Magistrate's Court today (Thursday) sentenced Dr. Ilan Halevi to only nine months of community service, who was convicted of the offenses of negligent medical treatment, illegal termination of pregnancy and obstruction of justice, after he illegally established a birthing complex on the territory of his home. In addition, he was sentenced to pay financial compensation to two female patients in the amount of NIS 35,000.
Halevy was convicted about six months ago after giving birth to many women in the pirate clinic he opened in his home. Some of the women he delivered had undergone caesarean sections in the past, and home births are dangerous for them. During one of the births, the uterus of the woman giving birth ruptured, and Levy did not take care of her evacuation to a hospital on a way that would ensure her safety. He sent her on her way in the family car driven by her husband, without medical escort and without warning to the hospital, where she underwent emergency surgery to save her womb and her life. In another case, the parents of a baby girl alerted Halevi that she felt ill, but he reassured them , and did not provide her with medical care or tell her to go to the hospital. The baby died a few days later.

"I got the impression that all the offenses were committed in light of the defendant's feeling that he was being persecuted, and that the state does not allow him to treat his patients according to his professional judgment," said Judge Eliana Danieli during the sentencing.
"There is nothing in the said defendant's feeling to show that the state did indeed persecute him, and in the verdict I rejected this defense claim, and determined that the defendant was negligent in the treatment he gave and as stated endangered the patients."
"Yes, I find the beating of the accused for a sin to be taken into account in his last words for punishment, when he claimed that he regrets and is ashamed for not acting in accordance with the standard of behavior appropriate for a doctor," added the judge.
"Also, the prolonged detention of the accused must be taken into account - about five months of actual detention, and then house arrest in handcuffs for seven months. Examining the parties' positions on the punishment - a longer prison term than this, versus a conditional prison term, brought me to the conclusion that two extreme positions were presented to me, which were not can be verified and which do not serve the purpose of punishment in this case."
