Another setback for IOMA: Justice ordered to provide coverage at no additional cost to employees of a municipality that deregulated affiliation

2024-02-21T20:52:11.325Z

Highlights: The Supreme Court of Justice of the Province of Buenos Aires ordered the Obra Medical Assistance Institute (IOMA) to continue with collective coverage for Municipal employees. In March of last year, the then mayor of San Nicolás sent a draft ordinance to the Deliberative Council to disjoin the municipality of IOMA. "Workers deserve to be able to see their doctor of choice and anywhere in the city; and the doctors get paid in a timely manner for these benefits," Manuel Passaglia said at the time.

It was in San Nicolás, where an ordinance was approved that enabled municipal workers to opt for other social work. The majority did so, but the organization tried to charge an extra fee to those who decided to stay in the Buenos Aires system. The Buenos Aires Supreme Court ruled against it.

The judicial chapter between a former mayor of San Nicolás (from Together for Change) and the government of

Axel Kicillof

for the social work of municipal employees has just favored the former communal chief

Manuel Passaglia

.

The Supreme Court of Justice of the Province of Buenos Aires ordered the

Obra Medical Assistance Institute (IOMA)

to continue with collective coverage for

Municipal

employees who chose to continue with that benefit.

In March of last year, the then mayor Passaglia sent a draft ordinance to the Deliberative Council to disjoin the municipality of IOMA.

"Workers deserve to be able to see their doctor of choice and anywhere in the city; and the doctors get paid in a timely manner for these benefits.

With IOMA it doesn't happen

, we have already raised it many times and it is useless to continue waiting for them to do something for improving it," Passaglia said at the time and received the support of Mauricio Macri.

Then Passaglia - who was succeeded by his brother Santiago, winner of the municipal elections - enabled the option to transfer the contributions to another social work, while closing a new collective coverage agreement with Avalian (former ACA Salud).

Thus, 85% of the municipal plant opted for Avalian, which provoked the

reaction of the provincial government

, where they accused the mayor of defunding the IOMA and attacking the institution.

They even forced

employees who decided to remain

in the provincial social work to

recontract the benefit

individually and voluntarily, assuming

an extra charge

.

The provincial health organization is led by the leader of

La Cámpora,

Homero Giles, who receives strong criticism from the opposition - they tried to question him in the Legislature - and from members, who protest for failures in care and lack of important supplies, such as oncological medicines.

With this week's court ruling, the municipal member

no longer pays that extra charge

that IOMA intended for already members and returns to the previous collective system, so the Municipality must only settle the mandatory contributions established by law as it did previously. to the ordinance of Saint Nicholas.

But also, now the door is opened to

other Buenos Aires districts

that had already expressed their intention to replicate the measure but encountered various obstacles.

Mauricio Macri supported Manuel Passaglia in his project so that the municipalities can choose to leave IOMA.

Tension at the IOMA headquarters in La Plata

This Wednesday there were moments of extreme tension when a group of affiliates of the Medical Assistance Work Institute (IOMA) wanted to force their way into the headquarters located in La Plata.

There was pushing, shouting and fighting between the protesters and the security forces guarding the building.

But La Plata was not the only focus of conflict.

In other parts of the Province of Buenos Aires, such as Mar del Plata and Tandil, similar situations were experienced.

At the door of the building located at 46 between 12 and 13, protesters with banners and megaphones demanded to see the IOMA authorities to present various complaints.

Among them, the "organizational and coverage failures" that they have been suffering for some time.

"They don't allow us to enter the hall, we are all big people, what can we do? Are you afraid that we will scare you? We are going to do it," the woman attacked.

This Tuesday, different representatives of the blocks of the Buenos Aires Chamber of Deputies had held a

meeting with the head of IOMA

, Homero Giles, to analyze the benefits of that entity and the situation of payments to professionals and health providers.

The ruling party there resists Axel Kicillof's official being questioned in the Buenos Aires Legislature.
