The People's Assembly approved at its 24th session of the 11th ordinary session of the second legislative session under the chairmanship of Speaker Hamouda Sabbagh the amendments to the Constitutional and Legislative Affairs Committee concerning the law of the State Council.

The Council noted that based on the letter of the President of the Republic No. 48 dated 28-10-2019, which includes not issuing the Law of the Council of State to remedy the observations made on a number of its articles and after reviewing the decision issued by the Supreme Constitutional Court on 7-11-2019, the Council approved amendments The Committee on Constitutional and Legislative Matters concerning the law, which included additional articles.

A number of articles and paragraphs were amended within the articles of the law, including Article 1 to become "the State Council is an independent judicial and advisory body in charge of the administrative judiciary headquartered in Damascus and issued its judgments in the name of the Arab people in Syria" and article 5, paragraph 3 to read " At least one of the first-class deputies shall be appointed by the investigator of this court, one of the judges of the Council of State at the rank of at least a first-class deputy. ”Article 12 reads:“ Applications from persons with no personal interest shall not be accepted. ”

Article 21, paragraph 1, has been redrafted to read “The date of filing the case before the Court in respect of the cancellation requests shall be sixty days starting from the day following the publication of the contested administrative decision or communicating it to the concerned party. The appeal shall be decided before the lapse of sixty days from the day following the date of filing it. If the decision is rejected, it shall be reasoned and it shall be considered 60 days after filing the grievance without being answered by the competent authorities as a rejection. Article 27 has become “retrial in judgments issued by administrative courts, administrative courts or courts of law in accordance with the dates and procedures stipulated in the Code of Trial Procedures. The Judicial Authority Act and its amendments and the Basic Personnel Act No. 135 of 1945 and its amendments shall apply to judges of the Council of State in all matters not provided for in this Law.

The Council referred the letter of the President of the Republic containing the return of some articles of the law on the objectives and tasks of the Ministry of Higher Education and Scientific Research to a joint committee of the Committee on Constitutional and Legislative Affairs and the Committee on Education and Scientific Research to remedy the observations made on it.

The report of the Committee on Constitutional and Legislative Affairs was presented with the possibility of considering the draft law containing the mechanism of appointing repeaters in private educational institutions and was referred to the Committee of Education and Scientific Research for its consideration.
