This Thursday, the hearing of the 14th criminal chamber of the Bobigny court was entirely devoted to disputes involving police officers.

In the register of burrs, that of a peacekeeper of Stains.

A year and a half apart, he finds himself in two tough questions.

The first begins in a parking lot in Stains at 1 a.m. in August 2017. A young man is chatting with two friends in a car, engine off.

A police patrol approaches it and everything goes wrong.

Blows according to the victim, a "technical gesture" according to the police

The young man asks: "Why are you controlling us?

»He is rewarded with a« shut up », then he is tackled to the ground and receives three punches to the head.

When getting into the vehicle, he was struck again.

At the police station, a new volley of beatings hit him "in the stomach and in the genitals", he accuses.

Bobigny, Thursday November 5.

Cheikh Gassama had lodged a complaint following a police check in Stains.

This detailed story told by the victim is completely different from the police version.

The agent, currently on mission in Africa, cannot give details at the hearing.

But during his hearing at the IGPN, the police, he admitted just "a slap", that his colleagues sometimes qualify as a "technical gesture" or "stealthy blow".

In solidarity, they admit "not remembering punches worn".

Of this night check, there is no written record.

"An oversight", indicates the policeman.

At the bar, the victim, Cheikh Gassama, 28, is dressed in his green uniform of RATP agent.

He explains: "I warned and the policeman told me he didn't care."

Elements which did not convince the court, which releases the police officer on this first case: "We do not have sufficient proof that it is indeed him who gave the slap which is seen on the video".

A second file that leaves no doubt

In the second case, it is quite different.

An audio recording and a video are sufficiently eloquent to condemn this same police officer to 9 months suspended sentence accompanied by two years of prohibition to exercise the profession of police officer.

He will have to pay a fine of 500 euros for physical injury and 1,500 euros for moral injury.

On December 31, 2017, he had checked a car in Saint-Denis near the Stade de France which was driving at high speed.

On board, Sofiane B. disputes this.

This greatly displeases one of the policemen wearing glasses who lets him know by giving him "three punches in the face" and by meaning: "Welcome to 93. Get out of there."

Here we are not in the 13th century, it's not the same.

"

"How much do you estimate my hand in your mouth?"

A complaint is filed.

The public prosecutor seized the IGPN.

Sofiane comes to the medico-judicial unit (UMJ) to have his injuries noticed and comes out with 7 days of ITT (total incapacity for work).

Since then he still suffers from tinnitus and headache.

During the check, one of Sofiane's friends took care to activate his telephone recorder.

We hear: "You shut your mouth.

Next time, it won't be slaps ”.

Or again: "How much do you estimate my hand in your mouth?"

A surveillance camera filmed the scene and the violence.

If this evidence overwhelms him, the police can count on the support of his colleagues.

They admit "a slap to calm the driver" and "a friendly pat on the arm".

A policeman "exhausted by his pace of work" according to his lawyer

"We just asked him to be silent," explained the police officer sent back to correctional.

And he charges the victim: “She behaves on the verge of contempt.

"

Me Jean Briand Mboutou Zeh, Sofiane's lawyer, is astonished by "this slap that causes seven days of ITT".

The public prosecutor notes "that no procedure has been drawn up for this road check".

“It's surprising,” he notes.
