The government continues to empower registered medical practitioners to compel testing for anyone suspected of contracting COVID-19 in their clinical judgment for a period of 14 days from April 2 to April 15.


The Government cited the Prevention and Control of Disease (Compulsory Testing of Certain Persons) Regulation (the Regulation) (Cap. 599J) to gazette the above arrangement.

During the specified period, if a registered medical practitioner suspects that a person has contracted COVID-19 according to his clinical judgment in the course of professional diagnosis and treatment, the doctor may issue a written instruction requiring the person to undergo a nucleic acid test for COVID-19.

Those who receive written instructions should complete the test within two days of the date of the instruction.

Subjects under written instructions can choose from the following testing routes:

(1) Use the sample bottle provided by the registered doctor who issued the written instructions to collect the deep throat saliva sample, and return the sample bottle to the designated sample collection point within the test period.

Registered medical practitioners who have given written instructions and notified the Department of Health will be notified of the test results; or

(2) Arrange to accept the test provided by a private laboratory recognized by the Department of Health within the test period, and send the registered medical practitioner or his medical clinic with written instructions by email, fax or paper within four days after the test period. Person submits test results.

Any relevant person who fails to comply with the mandatory testing instructions commits an offence and is liable upon conviction to a fine at level 4 ($25,000) and imprisonment for six months, with a fixed penalty of $10,000 for discharge under the relevant legislation.

The person concerned may also receive a compulsory testing order requiring the person to undergo testing within a specified period. Failure to comply with the compulsory testing order is punishable by a fine at level 5 ($50,000) and imprisonment for six months.
