The Defense Ministry is examining whether the death of the Palestinian worker yesterday in the Shukda Forest will be considered a hostile act, which will entitle his family to compensation from the National Insurance Institute. This is what Israel Hayom found out on Sunday evening.

The Gaza worker was killed last Saturday when a rocket hit an open area in the Sdot Negev Regional Council, where the construction site where he worked is located. The brother of the deceased, also a resident of the Gaza Strip, was seriously wounded by the rocket, and a Bedouin who worked as a security guard at the construction site sustained minor injuries. After the rocket hit the site, it became clear that the construction of the protected area had not yet been completed, and that work there had taken place contrary to the instructions of the Home Front Command.

The fatality, 'Abdallah Abu Gabba, 35, was first evacuated to Soroka Hospital in Beer Sheva, suffering from injuries to his abdomen and chest, and died in the operating room. His 40-year-old brother also underwent surgery.

The Compensation Law for Victims of Hostilities states that any Israeli citizen or person who entered Israel and resided there according to the law (tourist, foreign worker, Palestinian worker, etc.) will be recognized as a victim of hostilities and will be entitled to rights from the National Insurance Institute. After Abu Gabba's death, the Ministry of Defense began investigating whether he was indeed working in Israel legally, that is, within the framework of the 17,500 work permits given to Gaza residents to work in Israel.

The professionals in the Ministry of Defense are required to determine whether he was indeed legally present in Israel, and if so, it is very likely that he will be recognized as a victim of hostilities and his family will be entitled to rights from the Israeli National Insurance Institute.
