This Friday, the ex-boyfriend of Shaïna Hansye was sentenced by the assize court of minors of the Oise to the sentence of 18 years of criminal imprisonment. Almost four years after the events and after a 5-day trial, Ousmane (not her real name) was found guilty of the murder of the 15-year-old girl, who was stabbed and burned alive on 25 October 2019 in Creil.

On October 27, 2019, the charred body of the girl was discovered in a garden shed in the Plateau district of Creil. Three days later, investigators from the judicial police (PJ) of Creil arrested Shaïna's boyfriend, designated as the perpetrator by several people in the Plateau district, where the crime was committed.

And in particular by one of his friends to whom the accused, 17 years old at the time, would have confided to have killed his girlfriend, detailing how he had done it. The motive for the crime advanced by the prosecution? The announcement of a pregnancy, made a few days earlier by Shaïna to Ousmane, which the latter would not have accepted. In detention, a prisoner claims to have heard him confess to having "killed his girlfriend who was a whore he had impregnated".

"There are solid elements that have been put together"

Sexually assaulted in 2017, Shaïna suffered from a reputation as an "easy girl" in the neighborhood. According to Zoé Royaux, a lawyer for the Women's Foundation who is a civil party, it is "because of this reputation" that Ousmane gets in touch with the victim to maintain a relationship with her, "because he knows she is vulnerable and fragile".

On the side of the defense, provided by Me Elise Arfi and Me Adel Fares, it is the acquittal that was pleaded. "He denies the facts since day one," Arfi said. The lawyers questioned the testimonies deemed "second-hand" or carried out in a spirit of vengeance against the accused, some material elements such as the marking of the phone or the burns on Ousmane's legs could be caused by the fire.

Me Negar Haeri, lawyer of the Hansye family, praises precisely the "courage" of the witnesses against "whose reliability is no longer to be proven". "He says he is in court only because of the rumor. But, in two years of investigation, there are solid elements that have been constituted and requests for acts have been made on the side of the civil parties as well as the defense".

At the end of his closing argument, Advocate General Loïc Abrial had asked for a sentence of thirty years' imprisonment, requesting the lifting of Ousmane's excuse of minority at the time of the facts. "There is a real premeditation and preparation of the crime. And at each stage, from the moment he gives an appointment to the victim to the moment he burns his body, he could have stopped, says the magistrate. There was a determination in him to go all the way. »
