The Jerusalem District Court on Thursday convicted Netanel Urquiza, 34, a resident of Nokdim, of rape and indecent assault on a minor under the age of 16, as attributed to him in the indictment.

According to the indictment, in the afternoon of August 2021, the five-year-old girl entered the defendant's home to drink water. The defendant, who was there at the time, called her into the bedroom, sat her down on the bed and played with her. He then called her to follow him to the bathroom, where he performed sexual acts on her. He then led her into the bedroom, poured wine on his penis, and performed sexual acts on her again, while she cried and said she was in pain.

The defendant stopped his actions only when his wife entered the bedroom and found him naked above their bed and the minor girl with her underwear rolled up and she was crying and frightened. In his answer to the charge, the defendant claimed that he did not remember anything described because he was in a state of intoxication.

The Jerusalem District Attorney's Office (criminal), through attorney Miriam Ben-Gal, argued that the defendant did not prove that he was drunk at the required threshold, and that he consciously put himself in a state of intoxication.
