Former State Prosecutor Moshe Lador criticized the remarks made by the judges of Netanyahu's trial panel to the State Prosecutor's Office in a closed conversation on the difficulty of proving the bribery component of Case 4,000. Lador said that "this is an unprecedented mishap that occurred in court." "This is a grave and disgraceful start. We didn't give the prosecution the chance."
According to Lador, the judges at most heard a series of witnesses randomly and could be impressed, perhaps temporarily, when the full picture was not before them. They know that behind the bribery charge, the system and all its senior officials, the attorney general, together with the state prosecutor, the senior investigators, think that this is a bribery affair."
"They didn't think that minutes after the discussion it would reach Netanyahu, and all those around him, who see a gem and an extraordinary opportunity - 'Here the case crashed.' It was a real terror attack, that's not how you manage a case, certainly in an affair of this kind that the whole country is dealing with this question."

Lador said that he did not see a situation in which this case could be won: "I don't believe that a verdict of acquittal can be written. I never, in any case, say that I know what the judges will rule. I am not a prophet. But knowing you, knowing some of the materials before them, there is no legal possibility of writing a verdict of acquittal. Even if they accept the twists of Filber and some of the others, it is impossible. The offense of bribery is an offense that does not require any action on Netanyahu's part in favor of Elovitch. Elovitch allegedly bribes Netanyahu."
When Lador was asked whether there was excessive motivation on the part of the prosecution in this case, he replied that "there was an over-motivation for a recession, for softening the investigation. The charges chosen in the indictment were over-motivated by Attorney General Mandelblit. He was the one who really softened. It was Netanyahu who appointed him. He had no interest in harming Netanyahu in any way."
Regarding the judges' statement that in the interest of the matter and the state the trial should be ended, he said: "I think the opposite. They don't have to deal with this question for the good of the country, they don't have to take it into account at all. They shouldn't. They boast all these years that the winds blowing outside the courtroom won't affect them, they're not politicians, I don't know which side they represent when they say that."
Lador added: "They should have done the opposite. The public has been engaged in this matter for years, arguing against the entire enforcement system, the police, investigators, prosecutors, the attorney general, and the courts. They said they stitched up a dossier, they want to remove a sitting prime minister, and that's an improper use of the system's powers. There must be a decision. Instead of the State of Israel against Netanyahu, it is Netanyahu against the State of Israel, and he has been waging this campaign throughout the entire period."
