After the Spyware Inquiry Committee, headed by Justice Moshe Drori, summoned the Attorney General to discuss the committee's powers, Gali Bahar-Miara recently replied in a letter to the committee that a meeting will take place only after the High Court of Justice has decided on petitions against the committee. The attorney general did not respond to any of the dates of the meetings offered to her.

Earlier this month, the committee summoned Bahar-Miara to appear at its first meeting. The committee contacted the attorney general to coordinate a date for a meeting, in which she would present her views on the committee's powers. Previously, she had already expressed her opposition to the committee's authority to examine the spyware issue in ongoing cases, with an emphasis on the prime minister's files.

As noted, in a letter of reply she recently sent to the committee, she announced that such a meeting would take place only after the High Court of Justice ruled on the petitions filed against the committee. If the committee decides not to proceed with the examination and wait for the meeting, the attorney general's position would mean a months-long delay in the committee's work, at least with regard to spyware in ongoing cases.

Replied to the Minister

The petition against the establishment of a commission of inquiry into the use of spyware in the Israel Police was submitted to the High Court of Justice by the "Black Robes Struggle" organization, together with former Shin Bet head Nadav Argaman and former Defense Ministry Director General Maj. Gen. (res.) Amir Eshel.

The petition was filed after the government approved the establishment of the committee in accordance with Justice Minister Yariv Levin's proposal and despite the opposition of the attorney general. The Attorney General acceded to the Justice Minister's demand and authorized him to receive private representation in petitions that would not be provided by a jurist from the civil service.
