The big picture

  • At the end of last year, Ben Yehuda posted a 41-minute video on his Facebook account called "The Right with Benjamin" detailing his political views. At about the 26th minute, Ben Yehuda criticized Ben Ari for appealing to the court against the statements made by another activist affiliated with support for the Likud and Prime Minister Netanyahu, Orly Lev.
  • At the same time, Ben Yehuda said the following, as he raised his voice and patted his chest: "Did you see in Orly Lev's trial what a state prosecutor was nominated for? Chief Prosecutor? Going for a tweet! So I will say - hello, where is your son? Come tell us. Where did your son disappear? Shwicky Where did he disappear? Ben Ari's grave?... What did they waste seven hours on? About a post Orly wrote? Where is Shawki? Tomer Shuki Where are you? We're looking for you! Hello! Liat Ben Ari's son, you, come tell us what the problem is."
  • As a result, the Israel Police filed an indictment against Ben Yehuda for the offense of threats.

Bottom Line

  • Today, Judge David Shaul Gabbay Richter of the Jerusalem Magistrate's Court accepted Ben Yehuda's argument and ruled that this is not a threat prohibited by criminal law, because it is an expression of political opinion, and that Ben Yehuda's freedom of expression should be preferred to the peace of mind of the person who feels threatened.
  • The judge wrote that "the principle of freedom of expression should be preferred over other protected principles, such as the peace of mind of the person, one of the protected values in the offense of threats, and therefore the act or expression must be clearly threatening – one that will cross the criminal threshold. But that is not the case before us."
