Attorney General Gali Brahav-Miara responded to the High Court of Justice on Monday to a request that the court order National Security Minister Itamar Ben-Gvir to refrain from issuing orders and instructions regarding the exercise of the right to demonstrate.

As detailed in the response, a series of publications indicated that Minister Ben-Gvir intervened improperly and illegally in the work of the police. Particularly serious is the political interference with the freedom to protest against the regime and the right to demonstrate.

The minister's claim that he sought to prevent a show of solidarity with Hamas was made regardless of the circumstances of the demonstration, which the police examined and approved. In any case, the law enforcement system criminally prosecutes criminals who identify with Hamas, regardless of any social media posting.

The Office of the Minister of National Security said in response to the attorney general: "It is very regrettable that even after the events of October 7, the attorney general has not learned his lesson. This is an instruction from the minister not to allow support for Hamas. The fact is that throughout the demonstration the police feared that terrorist flags would be flown and acted on all levels against flying them. There is no incident that reaches the court's doorstep that the Attorney General does not act against Minister Ben-Gvir. This is an attorney general with a very clear agenda. According to every law, the minister has the authority to set policy regarding demonstrations as well, and certainly the minister has the option of ordering the police to enforce the law and not allow illegal demonstrations.

"Because of the hatred for Minister Ben-Gvir, the attorney general treats him as if he is the only minister who wants the ministry to uphold its policy, and as if previous internal security ministers did not instruct the police to carry out the policy they espouse. The minister will continue to instruct the police to enforce the law and not allow demonstrations of support for Hamas."
