Netanyahu can no longer fix it

The decline of the Israeli judicial system from its deserve, is not a new phenomenon. More than two decades ago, in 1998, I devoted an issue of the "Azure" conceptual journal I edited to the dangers inherent in the "judicial revolution" of Aaron Barak, that is, the legal arm's reptilian takeover of the Israeli regime, the legislative arm and the executive arm.

Since then, others - including myself - have written many more on this topic, including over the pages of "Israel Today". Most of the necessary changes are clear to all: the split of the Attorney General's job from the general prosecution system; Determining the legal advisers, headed by the Attorney General, as positions of trust; And a fundamental change in the method of appointment of judges. But for two decades, not only did the deficiencies not be corrected - but the exceptions of the justice system even worsened, until the crisis we foresee today. It is worth asking, who is to blame?

During this period, there were four prime ministers, none of whom considered it appropriate to address the increasingly serious problem. And more years than any other, along with Netanyahu, who has been prime minister for a decade. His tenure is longer than that of any other person in the history of the state, and so is his responsibility for the state of things.

During his first term as prime minister, and also as senior minister of the Ariel Sharon governments, he found it inappropriate to draw conclusions from the legal impeachment of Minister Jacob Ne'eman or the disqualification of Prof. Ruth Gavison to the Supreme Court. Since returning to the Prime Minister in 2009, It is real to correct the situation, even as the legal advisers have adopted governmental powers as they see fit, and when the Court has repeatedly repealed the Knesset's laws on the deportation of infiltrators. If that is not enough, Amit Segal recently revealed that Netanyahu not only avoided action, but also proactively blocked any attempt at significant reforms in the judicial system, and on his mission sent the minister as a window to veto such initiatives.

Prime Minister Netanyahu is credited with many achievements in other areas, but an election campaign is not an award ceremony for city veterans for their contribution to the community. Elections are a decision on the ability of various candidates to benefit most for the state and its citizens, if elected. Therefore, we must understand that when Netanyahu now goes against the system The sentence for hurting him can only be blamed for this state of affairs, but the truth we must admit is much more bitter and serious: Netanyahu no longer has the ability to correct the system. , And will avoid any possibility of making substantial changes. In doing so, Netanyahu himself became the main barrier to the necessary changes.

We must thank him for his contribution, and replace him with the person who is least likely to make the necessary changes. Who is this man? In all of Netanyahu's years, there has been one positive change introduced by the judges' appointment, by first granting a veto to elected officials for appointing judges from among my dearest presidents. This change was taken advantage of by Netanyahu's permanent veto, only because those who initiated and led it were able to obtain the judges' consent at the time (an agreement they have since regretted severely). His name was Gideon Sa'ar.
