The Supreme Court of Justice refused this Tuesday afternoon to excuse itself to continue intervening in the request for suspension of the elections for governor and vice governor in San Juan.
Earlier, the provincial State Prosecutor's Office had crossed the highest court by maintaining that its ruling violates "provincial autonomy" and warned that they could recuse its members.
The head of that agency, head of the province's lawyers, said almost in tune with Governor Uñac: "When a precautionary measure is issued, it does not imply an advance of opinion. But in this case, in the recitals it says that the Provincial Electoral Tribunal formalized the candidacy of Sergio Mauricio Uñac for a fourth term. When he speaks of a fourth term, he is establishing a legal position that the challenger (Vallejos) is right. What defense can we raise if he has already established a position?"
San Juan's lawyers asked the ministers to excuse themselves for alleged prejudgment. If they did not agree to do so, they raised their recusal.
But the Court also rejected San Juan's challenge.
Last Sunday, elections were held in the province for mayor and provincial deputies but not for governor and vice president, until the substantive issue on the precautionary measure that the Court resolved when accepting a request from the opposition is resolved.
