According to the lawsuit, Cosby allegedly drugged and raped the complainant, a woman named Donna Motsinger, in 1972 while she was working as a hostess at a restaurant in California. In the lawsuit, Motsinger also included Cosby's production company, Jemmin Inc., MCA Inc. and Circle Star Theater Corp., on the list of defendants, alleging that they did not provide protection to attendees from their coaches.

"The production company bears indirect responsibility for Mr. Cosby's sexual assault as it enabled his acts," court filings allege. "The company is guilty of fraud, suppression and malicious intent in Ms. Motsinger's case at Cosby's hands," it said.

Motsinger said Cosby, who was a regular guest at the restaurant where she worked, followed her home one night and asked her to come watch him perform at the Circle Star Theatre. He picked her up in a limousine, where according to the lawsuit he watered her with wine. She said Cosby led her to his locker room, where she began to feel unwell and he gave her what she believed was an aspirin pill.

The next thing she remembers, she elaborated, was herself vaguely conscious when two men helped Cosby get her into a limousine where he sat down next to her and put his hands on her. Motsinger goes on to detail in the lawsuit that she woke up at home with no clothes other than her underwear. That's when she realized she had been drugged and raped by Cosby, she said.

Motsinger claims that as a result of the sexual assault she suffered economic and non-economic damages, including loss of earning capacity, medical bills, physical pain and emotional distress, and is now demanding the maximum compensation she is entitled to by law. The required amount was not specified in the claim.

In June 2021, Cosby's conviction for a series of serious sex crimes was overturned after he was sued by dozens of women, and he was released from prison after serving two years of his 10-year sentence in 2018 due to a legal process deemed improper. Since then, a series of new civil lawsuits have been filed against him.
