The State Prosecutor's Office filed an appeal today (Tuesday) with the Nazareth District Court against the decision of the city's Magistrate's Court to reject its request to detain actress Maysa Abdelhadi in interim detention, despite the high danger posed by her, and to postpone by 10 days the date of its decision on the prosecutor's request.

According to the State Prosecutor's Office, it is asking the court to order Abdelhadi's arrest or to bring forward the decision on the request for her detention until the end of the proceedings, due to the acute need to protect the public in the midst of the difficult battle in which we are embroiled.

The appeal, filed through attorney Yael Katz of the Northern District Prosecutor's Office, states that Abdelhadi, a film and theater actress in her 30s from Nazareth, was indicted for incitement to terrorism and showing solidarity with a terrorist organization. On the day of the murderous terrorist attack, she posted two inciting "stories" on her Instagram account, which has more than 27,<> followers and a high level of exposure.

These publications included pictures supporting the atrocities committed by Hamas in the south, praising the acts committed by Hamas terrorists and identifying with Hamas. In addition, shortly after the publications were published, she sent messages to her friends in a WhatsApp group praising and sympathizing with Hamas for the atrocities they committed in the south. The State Attorney's Office believes that under the concrete circumstances, there is a real possibility that its publications will lead to the commission of an act of terrorism.

Simultaneously with the filing of the indictment, the State Attorney's Office filed a request to detain her until the end of the proceedings due to the high danger she poses to the public. The judge who heard the application that day ruled that, without expressing an opinion on the merits of the request, she believed that Abd al-Hadi's freedom should not be taken away before studying the evidence and holding a substantive hearing in accordance with an existing evidentiary basis.

Yesterday, after the interrogation material was handed over to the defense attorney, Judge Raed Omari held a lengthy hearing, at the end of which he postponed the decision by 10 days and refrained from ordering interim detention.

The appeal argued that postponing the date for granting the decision for such a long period of time, while avoiding the defendant's interim detention, endangers the public, renders meaningless the state's request for detention until the end of the proceedings, and in fact severely harms the chances of appealing the final decision, should the state choose to submit one, when the decision is made.

"The State of Israel is in the midst of fierce fighting on two fronts, shortly after a brutal terrorist attack that claimed the lives of hundreds of civilians and members of the security forces," the appeal said. "It is precisely during these difficult times that the defendant chose to distribute incitement publications, pour oil on the fire, support terrorist operatives and spread hatred and hostility around her. Dangerous publications such as those she distributed create a very high risk of always fanning hatred, violence, terrorism and harming national security."

"Even more so, the risk increases given the charged and volatile public atmosphere prevailing today and the fear of escalation in additional sectors throughout the country. Given the difficult and volatile days that the State of Israel is going through, the danger of the defendant is magnified by sevenfold, when the things she publishes may be the spark that will ignite a great conflagration."

The State Prosecutor's Office emphasizes in its appeal that since the publication of Abdelhadi's arrest and release, the number of followers on her Instagram account has steadily increased, and now stands at about 33,<>. "The extent of the distribution and potential exposure of the defendant's Instagram account increases her danger and hence the need for her immediate arrest," the appeal states.
