A new protocol calls for 'five-year monitoring and termination clause' (ANSA)


(ANSA) - ROME, DECEMBER 6 - Strengthen the anti-mafia checks relating to the residual hypotheses of sale of confiscated real estate, for which the destination for social or institutional purposes was not possible. This is what the memorandum of understanding signed this morning by the National Anti-Mafia and Anti-Terrorism Prosecutor, Federico Cafiero de Raho, and the Director of the National Agency for the administration and destination of seized and confiscated assets from organized crime, Bruno Frattasi, provides.

The purpose of the agreement - signed in Rome at the headquarters of the National Directorate - is to prevent, thanks to rigorous investigations involving the involvement of the IT systems of the National Directorate itself, any attempt at criminal insertion in the disposal of real estate assets.

The protocol - which gives concrete follow-up to a specific indication contained in the Guidelines for the destination of real estate, recently approved by the Executive Board of the Agency, of which a representative of the National Direction is a member - also includes a monitoring of the purchaser and the other subjective figures indicated by the Antimafia Code for a five-year period following the sale, during which, upon the occurrence of contraindications, a rescission clause will be exercised, included in the sales contracts, with the consequent absence of the translational effects. The National Prosecutor and the Director of the Agency have expressed - in a note - their most "keen satisfaction with this agreement which, in reinforcing the synergistic relations between the two Bodies, guarantees further support to face resolutely the feared risk of interference sometimes to bring the good back into the hands of the criminal organizations that had been divested of it, without prejudice to the residual nature of these disposals, which will continue to be subordinated to the continuing objective impossibility of allocating the asset to the priority social or institutional aims provided for by the Antimafia Code ".
