"Exemplary behavior 10", yoga workshops, theater classes and health problems that placed him within the risk group against Covid-19.

All this opened the door of the jail to the motochorro -now murderer- Alejandro Miguel Ochoa (55), who once again brought into focus an imperishable controversy: convicts who do not finish serving their sentences, regain their freedom and, in the street, they repeat the crime.

Ochoa, who according to the sentence he received in 2017

had to leave prison on August 16, 2024

, was released in April of last year, benefited by a resolution of Chamber 1 of the Chamber of Appeals and Guarantees of Mar del Plata, integrated by judges Esteban Viñas and Marcelo Riquert.

The same judges, in February, had denied Ochoa house arrest and requested that he undergo medical studies.

Two months later they changed their minds. 

Already in April 2020, Investigating Judge Ricardo David Perdichizzi denied the benefit requested by the defense.

The prosecutor Marcelo Blanco also opposed the reduction of the sentence.

Among other considerations, Perdichizzi argued that Ochoa "does not have a disability or terminal incurable disease, has

COPD

as a base pathology

but it can be validly treated in the context of confinement", for which he

discouraged house arrest and denied it.


Ochoa was in the Batán Penitentiary Unit serving a sentence of 8 years and 4 months in prison for "

aggravated robbery and serious injuries

" for a crime in which he acted in the same way that ended the life of psychologist María Rosa Daglio (56 ) last Friday in Ramos Mejía: he surprised the victim and dragged her with the motorcycle to snatch a wallet.

Giovana Ingoglia (32) had a very bad time, but survived.

In the summer of 2016, the woman was waiting for a taxi with her mother to go to the theater when she was surprised by the roar of a motorcycle.

He had no time to react.

Ochoa dragged her a block;

the girl's right arm caught on one of the wheels.

My arm stopped the motorcycle,

" she recalls with anguish when she learned that the man who made her suffer an ordeal, three operations on her arm and a persistent fear of the sound of the motorcycles, now killed a woman.

He never knew that Judges Viñas and Riquert had sent him home ahead of time.

Indeed, the chambermaids explained in a brief letter that on April 29, 2020 they granted Ochoa home detention until the period of social, preventive and compulsory isolation (ASPO) remained in force and that for the granting of such benefit, they said , followed criteria established in different resolutions of the Court of Criminal Cassation and the Provincial Supreme Court.

The health report (patient with COPD - risk group against COVID-19 - and urological complication with the need for surgical intervention not practiced until then) and the report of the prison authority were taken into account

," they indicated.


That report from the technical-criminological department "

estimated the convenience of inmate Ochoa (with a good concept and exemplary conduct 10), accessing the house arrest regime,

" they explained.

In the resolution that released Ochoa, the judges listed "the

great adherence to the existing treatment proposals in the confinement environment, namely: his work performance in the chemistry of the penal unit, since 04/05/19 up to the present, as well as its maintenance task in the visits sector, since February 2018 (previously, in the kitchen and service sector of the surveillance and treatment section)

". 

In addition, "

the promotion of the first and second year of the secondary cycle (years 2018-2019) and their attendance at the yoga workshops (2019/20), theater (2016/17/18), Alcoholics Anonymous (coordinator in 2018 and 1019 ) and chess instructor (2016)

".

The chambermaids, in the letter in which they explain on which they based the granting of the benefit, clarified in the last hours that "

the incident did not return to the Chamber, so there is no record about the monitoring of Ochoa's situation by the administrative and judicial authorities of first instance

".

They were not aware of Ochoa's situation, they say;
