After the suspension for the decision of the Consulta on the end of life, the trial of Marco Cappato, accused of suicide aid for having accompanied Fabiano Antoniani, known as DJ Fabo, to die in Switzerland in February 2017 has resumed in Milan.
The trial, which is expected to result in an acquittal due to the ruling by the Constitutional Court, is being held before the Assize Court. In addition to Cappato, DJ Fabo's fiancée Valeria Imbrogno is also present at the trial. In the classroom there are many people in the audience.
The Constitutional Court's ruling on the "principle of sacredness of life (...) replaces the protection of human frailty," said assistant prosecutor Tiziana Siciliano in the indictment during which he explained that in the case of DJ Fabo all 4 requirements indicated by the Consulta that has traced the path on the non-punishment of suicide aid , an offense for which Marco Cappato responds. For this 'the fact does not exist' and the prosecutor asked for absolution for the radical exponent.
Cappato's defense requested the acquittal of the exponent of the radicals with the formula "because the fact does not constitute a crime" asking the Court to "take a step forward" and to have "legal courage".
During the trial Cappato, present in the courtroom in Milan, received the news of the death of his mother, who had been ill for some time. The lawyers of the radical exponent therefore asked for and obtained a brief suspension of the hearing which then resumed.
