Partial unemployment: the case of executives on a day package soon to be settled

A decree from the Ministry of Labor must extend the system to companies that have not had to close their doors.


Announcement effect, lack of precision or misunderstanding? After the intervention of the President of the Republic on Thursday March 12 and his now famous "whatever it costs" hammered three times, many business leaders believed that the problem of employees affected by the drop in activity was resolved . It would suffice to declare their partial unemployment, and the state would reimburse employers the amount paid (up to 4.5 times the minimum wage) to all those who are prevented from working by the Covid-19 pandemic. The first refusals from the DIRECCTE, regional branches of the Ministry of Labor responsible for processing requests, concerning so-called "day pass" employees made them disillusioned.

Reason invoked? The counting of the working hours of these executives (expressed in days over the year and not in hours per week or per day) is incompatible with partial unemployment. The labor code provides that they only benefit if the business is closed, but not in the event of a reduction in activity.
