A friend urgently needs a car - but you only have the company car at your disposal. Can employees lend their vehicle in such a case?

Cologne (dpa / tmn) - Some employees get a company car from their employer - and some of them can also use it privately. But what about if you want to lend the car to others? Is this allowed?

"The first thing that matters is whether there is a company car regulation," explains Nathalie Oberthür, specialist lawyer for employment law from Cologne. This can be found, for example, in the employment contract or in a company agreement. It can then explicitly stipulate, for example, that employees may only lend their company car to life partners or members of the household.

If there is no corresponding regulation, employees may in principle also lend the company car, says Oberthür. However, he should reinsure himself that the insurance cover also includes other drivers - otherwise workers will quickly fall into the liability trap.

Personal details: Nathalie Oberthür is a specialist lawyer for labor law and a member of the executive committee of the Labor Law Working Group of the German Lawyers' Association (DAV).
