Despite the corona pandemic, students are not entitled to online exams from home.
The examiners can determine the form in which an exam is to be taken - online or as a face-to-face exam.
That was decided by the Lower Saxony Higher Administrative Court (OVG) on Wednesday (file number: 2 ME 349/20).
The master's student at Leuphana University Lüneburg is a smoker and thus belongs to a risk group defined by the Robert Koch Institute.
Nevertheless, he must take part in the face-to-face test, according to the Lüneburg judges in their decision.
The decision is final.

The student had applied to be able to write the exam from home because of the corona pandemic.
However, the university rejected the application.
The student has to take the exam as a face-to-face test, this is also allowed again according to the Lower Saxony Corona regulation.
A hygiene concept had been developed for the presence tests.
The administrative court had already rejected an urgent application by the student against this university's decision.
The OVG now also approved the university's approach.
The examiners have a wide scope for assessment and design, which has not been exceeded here.
There are only manageable numbers of infections in northern Germany, and the health risk with a classroom exam is very limited.
