After a decision by the Federal Chancellor and the Prime Minister, daycare centers and schools will be temporarily closed.

For parents of small children, however, the corona lockdown is a major challenge, because they have to balance work and childcare.

Many then of necessity work from the home office.

In many professions, however, home office is not even possible.

What happens then?

Do parents still get their salaries?

Parents who cannot work are entitled to compensation for loss of earnings

In fact, there is financial support from the state, albeit not in full of the salary: if parents are unable to work to care for their children, they are

entitled to compensation in the event of loss of earnings

if the

childcare facility is temporarily closed

or entry is prohibited.

This emerges from Section 56 of the

Infection

Protection Act, which was

amended

in spring and lastly again in autumn.

Compensation for loss of earnings: This is how much money parents get

According to the Federal Ministry of Labor and Social Affairs (BMAS), compensation for loss of earnings is

67 percent of the loss of earnings

.

The sum is capped, however, and amounts to a maximum of EUR 2,016 per month for a full month.

The employer pays out for the first six weeks.

He in turn can get the compensation payment back from the competent authority.

The allowance is

granted for

a maximum of ten weeks

for each working parent.

Single parents receive compensation for 20 weeks.

The maximum period of ten or 20 weeks does not have to be used in one go, but can be spread over several months.

These requirements apply to the claim for compensation under the Infection Protection Act

But be careful: the claim for compensation only applies if the daycare centers and schools are

officially closed

.

The claim does not apply if there is only a recommendation to leave the children at home.

The specialist lawyer for labor law Nathalie Oberthür points this out to the German Press Agency (dpa).

These

conditions also

apply to the claim for compensation:

  • The children to be looked after must be

    under 12 years of age

    or

    need

    help because of a disability.

  • There must be no other reasonable care option.

  • The parents suffer a loss of earnings.

What counts as a “reasonable” care option is, however, controversial.

Another family member who is not working comes into question here.

But: "The 80-year-old grandfather does not have to be used to care," explains specialist lawyer Alexander Bredereck to the dpa.

After all, the person should not be endangered by the care.

This is definitely the case with corona risk groups.

Incidentally, there are also compensation payments

if a child is in quarantine in close proximity due to a corona case

and therefore has to be looked after at home.

No compensation payment during school holidays

However, the right to compensation does not

apply during school holidays or company

holidays, such as public holidays.
