FIRST ORAL

For each question, three numbered and sealed envelopes will be prepared and the candidate - who will be present in the exam center together with the secretary, while the commission will be connected remotely - will have to choose one.

At the center is a question of a practical-applicative nature, to evaluate the ability to frame legal problems and to argue their solution: the candidate must therefore identify the problematic issues, the applicable, substantive and procedural provisions, the relevant principles and any pertinent jurisprudential guidelines. The first oral will last one hour from the dictation of the question and in the first half hour it will be possible to consult the codes, also annotated with the jurisprudence and take notes.

The questions are prepared by the examining commission on the basis of guidelines prepared centrally to ensure uniformity.

After each discussion, the subcommittee (with 3 members instead of the traditional 5) will retire to the council chamber and communicate the outcome of the test to the candidate. Only those who obtain a score of at least 18 points are admitted to the second oral exam.

SECOND ORAL

will be held no less than 30 days after the first.

Estimated duration, between 45 and 60 minutes for each candidate, who will sit the examination before the subcommittee of the district of his own Court of Appeal. Five subjects (one between civil law and criminal law; one between civil procedural law and criminal procedural law ; three, including constitutional, administrative, tax, commercial, labor law, European Union law, private international law, ecclesiastical law), in addition to the legal system and the rights and duties of lawyers.

Among the subjects chosen by the candidate, civil law and criminal law must be included - compulsory in the written tests - if not already chosen for the first oral test. The candidate who in the second oral test obtains an overall score of not less than 108 points and a score of not less than 18 points in at least five subjects.

POSITIVITY OR QUARANTINE TO COVID-19

In these cases or in those of fiduciary isolation, the candidate may request a new date for the performance of the test, which must in any case be held within ten days of the end of the impediment.
