State and Medical Association v. Interns Organization: "Agreements not yet reached" Israel today

The state has informed the Labor Court that it will hold staff work on how to shorten the shifts and problems that have been discovered and seeks to update on progress in about three weeks.


Ongoing saga:

The state and the Medical Association oppose the request of the organization of interns for a prescription to repeal the interim order postponing the shortening of shifts.

In their response to the High Court, the state agrees to a further postponement of the shortening of shifts, as does the Medical Association.

The state's response indicates that it agrees to a further delay in implementing the shortening of the interns' shifts, and informed the Labor Court that it is still conducting staff work on how to shorten the shifts and problems discovered and seeks to update again in about three weeks (19.5).

Until then, there will be no shortening of shifts for interns and they will continue to work 26 hours.

As mentioned, Clalit Health Services, which operates three hospitals where the shortening of shifts was supposed to begin on April 1, petitioned the Labor Court and asked for an interim order to delay the shortening of shifts.

The interns' organization then filed a prescription claiming that the decision on an interim injunction was a "snatch" and sought to dismiss the decision as well as join as a party to the proceeding.

In the response of the Medical Association and the state to the Labor Court, they strongly oppose the inclusion of a registry organization.

"The registry does not have a status within the framework of labor relations, since the representative organization of doctors, including interns, is the Medical Association," notes Adv. Yael Bar-Lev of the State Attorney's Office.

The Medical Association's response stated that the tribunal was asked to reject the application for a prescription to revoke the interim order.

"There is a consensus among all parties that shortening shifts is not feasible and impractical in light of the number of physicians currently in the health care system," it read.

"This requires amendments and adjustments in the collective agreements and agreements have not yet been reached. In addition, the daily negotiations between the state, the Ministry of Finance and the Ministry of Defense have not yet ended, and the parties must be allowed to complete."

The Medical Association also mentions that "the registry does not have a collective status that allows it to be a party to the procedure. The Medical Association, and it alone, is the organization that represents all doctors in Israel."
