This was stated by the Supreme Court in the reasons for the verdict that sentenced the cc Alessio Di Bernardo and Raffaele D'Alessandro to 12 years in prison.

"The question of the predictability of the event" of injuries and then of death, in the case of the beating suffered by Stefano Cucchi by the CC, "is certainly out of the question, given the way in which the accused struck the victim, with blows violent to the face and in the sacral area, that is, in a way suitable to generate internal injuries that anyone is able to represent as a foreseeable consequence of this action ".

The Supreme Court underlines this by rejecting the appeals of the CC authors of Cucchi's beating who claimed the "anomalous course" of his death.
