The absence of the aggravating circumstance determined the prescription of the crime of slander. 

According to the Public Prosecutor's Office, the defendants, who belonged to the pool charged with investigating the massacres of '92, under the direction of their boss, Arnaldo La Barbera, who later died, would have created the false repentants Vincenzo Scarantino, Salvatore Candura and Francesco Andriotta. feeding them and forcing them to lie and to accuse people who later turned out to be innocent of the massacre: hence the protest of slander.

The castle of lies built thanks to the false collaborators of justice would have helped, for the prosecutors, the real culprits to get away with it and covered for years the responsibilities of the Mafia clans of Brancaccio and its bosses, the Graviano brothers.

And for this reason, the prosecutor charged the three policemen with the aggravating circumstance of having favored the Cosa Nostra.

An aggravating circumstance which evidently did not stand up to the scrutiny of the court and resulted in the limitation of the crime charged to two of the three accused.

The third was, however, acquitted on the merits with the formula "because the fact does not constitute a crime".

Only the work of the Nissen prosecutors and the statements of the repentant Gaspare Spatuzza, who redesigned the responsibilities in the attack of the clans who remained out of the investigation, and who cleared the accused unjustly accused, revealed a misdirection, defined by the judges of the last trial on the death of Borsellino as the most serious in the history of the Republic.

Misdirection that this sentence does not exclude.
