The spirit of Kurt Cobain can now rest in peace: Nirvana have obtained the filing of the lawsuit for the cover photo of 'Nevermind', brought by Spencer Elden, portrayed as a child in the iconic shot of the cover of the most famous album of the Seattle band swimming naked in the pool.
"It's been over ten years since Elden learned of the fact," argued Los Angeles District Judge Fernando Olguin.
Elden had accused the famous grunge band of child pornography for the image in which he chased a dollar bill hanging from a fish hook as a child.
However, Olguin said the man waited too long to accuse Nirvana of sexually exploiting him.
Former band members Dave Grohl and Krist Novoselic, Cobain's widow, Courtney Love, several record labels and photographer Kirk Weddle, author of the album cover shot perhaps more famous of the band.
Weddle had photographed the baby in 1991 at the Pasadena Aquatic Center in California.
In the lawsuit, which began in August 2021, Elden had spoken of emotional stress, loss of earning capacity and "loss of the enjoyment of life" and that everything had continued into adulthood, but the judge rejected these arguments again. .
The decision was the third in a series and it will now be impossible for Elden to return to the charge.
