The first decree of the Meloni government, which postponed the implementation of the Cartabia reform on criminal justice to 30 December, is being examined by the Constitutional Court.
The question of constitutional illegitimacy was raised by the judge of Siena Simone Spina, also with the exception of the lawyer Paolo Lorenzini, defender of a defendant accused of private violence and damage;
crimes that with the entry into force of the reform would have become punishable only on complaint.
In the case in question, the lawsuit was withdrawn and therefore the case should have been closed without consequences for the accused.
