The judges of the Caltanissetta court write it in the reasons for the sentence on the misdirection of the investigations into the massacre in via D'Amelio.
The trial ended with the statute of limitations of the crime of aggravated slander contested against the policemen Bo and Mattei and the acquittal of the third accused policeman, Ribaudo.
To demonstrate the interference of third parties would be "the anomalous timing of the massacre in Via D'Amelio (which took place just 57 days after that of Capaci), the presence reported by the pentito Gaspare Spatuzza of a person unrelated to the mafia at the time of delivery of the Fiat 126 stuffed with TNT and the disappearance of Paolo Borsellino's red diary".
In this regard, the judges write: "Unless we hypothesize improbable scenarios of Cosa Nostra members wandering among dozens of members of the police forces, it can be considered certain that the disappearance of the red agenda cannot be traced back to a material activity of Cosa Nostra ".
