Rist law in hospitals: the Council of State maintains the ceiling on the salaries of temporary doctors

The administrative justice has decided: the Council of State validates the cap on the salaries of temporary doctors, in a decision made public this Thursday. Since April 3, in application of the so-called "Rist" law of April 26, 2021, the maximum amount is 1,390 euros gross for 24-hour custody.

The National Union of Hospital Replacement Physicians, which opposes any cap in the name of freedom of practitioners, had filed an appeal against this entry into force. He denounced in particular "legislation made blindly, because there has been no impact study", as well as "its disastrous effects on the functioning of hospitals". But he did not win his case at the end of the hearing, which was held on Tuesday, May 2.

"The interim relief judge notes that none of the means put forward by the National Union of Substitute Doctors in Hospitals is such as to raise serious doubt as to the legality of the contested ministerial instruction," reads the decision.

'Cannibal interim'

The Minister of Health and emergency doctor by profession, François Braun, assumes to want to fight against the "cannibal interim" with salaries that can rise - in rare cases - to 4,000 euros gross. But with these rates blocked, some hospitals, already in difficulty, are struggling to keep all the staff accustomed to working from home. This situation has led to partial or total closures of services, particularly in emergency rooms. François Braun prefers to affirm that there is no "dry closure", referring to the fact that an alternative solution is systematically proposed to each patient.

Some emergency doctors fear that May and June will be even more "tense" than April, during which hospital management has often found alternative solutions (previous contracts extended, more remunerative "reason 2" contracts, temporary workers agreeing to stay a few weeks at a capped rate, etc.).
