Comments on the latest decree law on migrants passed by the government have been expressed by the Chamber of Deputies' Research Service, which, in particular on the measures concerning the detention of minors, calls for coordination with the legislation already in force. In the crosshairs, among other things, is the possibility, introduced by the decree, of detaining minors of at least 16 years of age in ordinary extra-extraordinary reception centers, in a section specifically dedicated to this age group. The experts of the Chamber of Deputies invite to evaluate the opportunity of coordination with the provisions of Legislative Decree 142 of 2015, "which establishes the principle according to which the unaccompanied minor may under no circumstances be detained at detention centers for repatriation (CPR) or welcomed at government centers of first reception".
It would also be necessary, according to the experts of the Chamber, to coordinate with another provision of the same legislative decree, according to which "pending the outcome of the identification procedures, the reception of the minor is guaranteed in the appropriate structures of first reception for minors provided for by law".
The Research Service then dwells on a further measure, the one that provides that the socio-health assessment of the age ordered by the Public Prosecutor's Office at the juvenile court is concluded within 60 days from the date of the measure; In this regard, the observations read, "the opportunity to deepen the coordination of the provision with what is provided" by an article of Legislative Decree 142, according to which "the detention of presumed unaccompanied minors in first reception facilities should be for the time strictly necessary and in any case not exceeding thirty days".
