"This is the first time that the Commission has launched an infringement procedure" on the basis of the Digital Service Act (DSA), a Commission spokesperson said at a press briefing. "After the formal initiation of the procedure, the Commission will continue to gather evidence, for example by sending further requests for information, conducting interviews or inspections. The initiation of a formal procedure authorises the Commission to adopt further implementing measures, such as provisional measures and non-compliance decisions. The Commission is also entitled to accept any undertaking given by X to remedy the issues at issue in the procedure. The DSA does not set any legal deadline for the conclusion of the formal proceedings. The length of an in-depth investigation depends on a number of factors, including the complexity of the case, the extent to which the company concerned cooperates with the Commission and the exercise of its rights of defence."
