The Court of Appeal of Brescia has admitted the appeal of Olindo Romano and Rosa Bazzi, sentenced to life imprisonment for the massacre of Erba, setting for March 11 the hearing at the end of which the judges will decide on the request for revision presented by the defense of the two spouses and by the substitute prosecutor of Milan.
The Court sued the civil parties and also the Attorney General of Milan, in the person of the substitute prosecutor CunoTarfusser. The judges will evaluate, at the end of the discussion between the parties, whether to reject the requests or accept the new evidence proposed by the lawyers Fabio Schembri and Nico D'Ascolo for Olindo Romano and Luisa Bordeaux and Patrizia Morello for Rosa Bazzie and order the review of the trial. In the massacre of December 2006, <>, Raffaella Castagna, her son Youssef, just over two years old, Raffaella's mother, Paola Galli and their neighbor, Valeria Cherubini, were killed. Only Cherubini's husband, Mario Frigerio, who died a few years later and who was a key witness in the trial, recognizing Olindo Romano as her attacker, survived, although seriously injured. Olindo Romano and Rosa Bazzi confessed to the massacre and then recanted but were definitively sentenced to life imprisonment.
The judges' decision is "a huge professional satisfaction" for Milan's substitute prosecutor, Cuno Tarfusser.
"It is a decision that repays me for some negativity I have suffered - explained the magistrate - but it is in line with what I have always strongly believed". Tarfusser had filed a petition for a review of the trial even before Mr. and Mrs. Romano and Mr. Bazzi.
