"I have never stated that the Council has in the past betrayed its constitutional mandate, which, moreover, would have been prevented by the intervention of the President of the Republic, who, as verbatim stated during the press conference 'has never allowed or authorized a function of the body that was different from that which the Constitution has assigned to him".
The vice-president of the CSM, Fabio Pinelli, specifies this, returning to his statements today.
"Referring to the last council meeting - he added - I noted the difficulties it was troubled by, caused by attempts at external interference in the functioning of the body, which led to the resignation of five councilors in office".
"Such traumatic events - according to the vice-president of the CSM - have even led some commentators to hypothesize the dissolution of the body, a hypothesis which I recalled but never shared nor made my own in the press conference. And I made no reference to the vice-president at the time. During the conference press I only noted that the events mentioned have objectively led to a slowdown in activity which this Council has proposed to effectively overcome".
"As for the - different - matter of the expression of the Council's opinions on bills - he continued - I have not stated that the Council has not acted correctly in the past, I believe that, in compliance with the constitutional division of competences and with art. 10 of law 195 of 1958, the Superior Council cannot interfere with the legislative policy choices that belong to the institutions representing popular sovereignty, but must decide on the repercussions of such choices on the functioning of the judicial offices".
