Rottach-Egern bathtub murder: Decision on resumption will be made in August

In the case of the Rottach-Egern bathtub murder, there could be movement in August.
Then the Munich I district court wants to make a decision as to whether the procedure will be rolled out again.

- So far, the lawyers and the public prosecutor's office have been allowed to comment in the so-called trial procedure.
The now 61-year-old defendant Manfred G. is accused of having drowned the then 87-year-old Lieselotte K. in the bathtub in 2008.
The caretaker of a residential complex in Rottach-Egern still denies the allegations.
In 2012 he was sentenced to life imprisonment.
At the time, the court had ruled out that the pensioner had fallen into the bathtub and drowned as a result of a fainting spell.
It relied on the expertise of a coroner, who found it impossible that the old woman had sustained her head injuries from a fall.
Expert opinion states: A fall is also very possible
In 2019, Genditzki's attorney, Regina Rick, filed for a retrial.
Her application contains the opinion of a professor of simulation technology, which shows the exact opposite: It is very possible and even probable that Lieselotte K. fell and suffered two hematomas on her head.
However, the District Court of Munich I had rejected this expert opinion with the indication that it was merely a question of mere "probabilities", not facts.
OLG: Computer simulation is admissible new evidence
The Higher Regional Court has now not followed this assessment.
The report with the computer simulation is an "admissible new piece of evidence".
The Higher Regional Court partially overturned the decision of the Munich I Regional Court and ordered that the Regional Court deal with the report and hear the experts.
Only then, according to the Higher Regional Court, can a decision be made on the application for reopening.
The same chamber that had previously rejected the application for reopening as inadmissible was responsible for this.
This hearing ended at the end of May.
After that, both the defense and the public prosecutor's office were asked to submit a statement.
The 1st Criminal Chamber now has to come to a decision – and it should be made in August.
