The butcher should have made sure that the sculpture "under no circumstances, no matter how children play with this bull, tips over", says a judgment of the Munich Higher Regional Court on a tragic accident in Krailling.
In 2016, the 200 kilogram bronze sculpture that stood in front of a butcher's shop was tipped on a boy.
The then six-year-old squeezed his hand;
part of a finger had to be amputated.
Metzger has to reckon with children playing
The owner of the Bavarian butcher's shop now has to pay 10,000 euros for pain and suffering.
The court ruled that the bull was not stable in Krailling.
The boy and his father had previously sued for compensation of almost 9,000 euros.
However, the Munich II district court had dismissed the lawsuit on the grounds that there was much to be said for the fact that the boy not only leaned against the sculpture, but also played on it.
However, the Higher Regional Court found this to be irrelevant: "Since the defendant had set up the sculpture in the public space in front of his shop, he had to (...) expect children to play with and on the animal figure and try to pull themselves up by the horns , climb the bull and "do gymnastics" on the sculpture, it says in the decision.
