School: appeal on masks in exams discussed, sentence pending

The administrative appeal with which the Lazio TAR is urged to decide whether the high school and eighth grade exams must be taken by students wearing a mask could be decided directly with a sentence.

Today, in front of the third section quater of the administrative court, the appeal proposed by Codacons to request the suspension of the ordinance with which the Ministry of Health on 28 April last ordered the obligation for students of '' wear the FFP2 mask in school environments.

According to what has been learned, the consumer association has raised the question of the constitutional legitimacy of the Decree-Law 52/2021 which, on April 22, ordered "Urgent measures for the gradual resumption of economic and social activities in compliance with the needs of containment of the spread of the Covid-19 epidemic ".

In essence, the Codacons appeal is centered on the fact that the provision provides for the obligation to wear a mask at school, "without this obligation also being envisaged for workers in general".

Although it is not excluded that the TAR decides by order, at the end of today's hearing the hypothesis has been made that the judges will directly issue a "sentence in simplified form" in the coming days.
