School: Pacific (Anief), Europe says yes hiring alternates

The temporary workers of the Italian school with 36 months of service must be hired.

For the second time, in the span of six years, Europe agrees with the Anief union, which has been fighting for the stabilization of school staff for years.

Last July 2020, the collective complaint presented by the trade union, which is based in Palermo, to the Council of Europe against the Italian State for violation of Article 1, paragraph 2 was accepted by the European Committee of Social Rights , of the European Social Charter, since the precarious situation violates the right of public education staff.

The first complaint was accepted in November 2014 with the now well-known "Mascolo ruling", which gave the right of employment to temporary workers with 36 months of seniority.

The details were illustrated in the afternoon during a press videoconference in which the national president of Anief Marcello Pacifico and the lawyers Vicenzo De Michele, of the Foggia bar, Sergio Galleano, of the Milan bar, Walter Miceli and Fabio Ganci of the Court of Palermo who assisted the union in the European Union.

If the Italian government does not comply with what Europe has reiterated, there is a risk of an infringement procedure.

"We have 200 thousand precarious teachers of the Italian school, with more than 36 months of service, who are unable to enter the roles of the State - explains the president of Anief Marcello Pacifico - because they have suffered an abuse of fixed-term contracts and because they are not included in the old rankings until exhaustion that the Parliament has reopened twice at the request of Anief until 2012 and also because the current extraordinary competition, once again, does not put them all in that different ranking that could lead them in the roles as always the Supreme Court and the Constitutional Court told us ".

To claim the right to be hired for an indefinite period are the teachers included in the school rankings, the first-tier qualified teachers included in the rankings until exhaustion, the second-tier qualified teachers not included in the rankings when exhausted and the third-tier ones not qualified who can demonstrate 36 months of service.
