Court verdict: woman slips on the dance floor – disco should pay 37,000 euros

A woman fell in a disco because of a puddle of drinks - and suffered broken bones. Is the operator liable for the injuries? Yes, the Karlsruhe Higher Regional Court decided.

If you run a disco, you have to check the dance floor regularly for puddles of drinks and broken glass - otherwise it could be expensive.

The Karlsruhe Higher Regional Court has sentenced the operator of a disco in the Neckar-Odenwald district to reimbursement of treatment costs and sick pay of around 37,000 euros.

According to the court, a visitor slipped on a puddle of drinks in December 2017 and injured herself.

Because of several broken bones, she had to stay in the hospital for two weeks and underwent multiple operations.

Your statutory health insurance sued the disco for damages.

In the first instance, the health insurance company failed.

The »dangers« of dancing

But the Supreme Court decided otherwise.

The court found that the disco operator could not prove that she had made sufficient "orders to control and clean the dance floor".

An employee should therefore keep an eye on the dance floor from the stage.

However, he was unable to see the details of the floor.

The disco operator must keep the dangers arising from "dancing" low in a "reasonable manner".

The Senate explained: "This cannot mean that an employee is constantly running across the dance floor with a floor wiper to remove puddles of drinks or broken glass."

However, "an effective check of the floor at certain intervals" is necessary.

The Higher Regional Court did not allow an appeal against the verdict.

The operator of the dance hall can lodge a complaint against this.
