"Acquitted does not mean innocent." With those words, the collective of Argentine actresses clarified the procedural situation in which the actor Juan Darthés is in the case in which Thelma Fardin denounced him for sexual abuse.
This afternoon, at 17 p.m., the artist, the collective and Amnesty International Argentina gave a press conference beforethe acquittal issued by the Brazilian Justice.
The human rights NGO also expressed itself on its Twitter account. "The acquittal of Darthés does not mean that the event did not happen, but that the judge assessed that the evidence was not sufficient to convict him," he said.
And like the actresses collective, Amnesty International was strong in its support for Thelma: Amnesty will continue to demand justice so that sexual abuse does not go unpunished."
The news caused a stir because on social networks, users and communicators claimed that the trial had been annulled because the actress had not provided evidence. Something far from reality.
Likewise, the National Campaign for the Right to Safe and Free Legal Abortion expressed solidarity with Fardín.
The ruling issued by the federal judge of San Pablo Fernando Toledo Carneiro was announced this Saturday by Darthés' lawyer, Fernando Burlando.
The actress denounced Darthés for events that occurred on May 17, 2009 during the tour of the play of Patito Feo in Nicaragua. At the time, she was 16 and Darthés was 45.
The sentence, of 58 pages, considers that the "libidinous" acts prescribed. But he doesn't deny they happened.
The judicial decision maintains that the abuse existed and that it absolves him because penetration is not proven.
It was necessary to prove penetration because the criminal type required it at the time of the facts: until 2009, it was considered "aggravated rape" when there was carnal access, which is what according to the judge was not proven.
If the abuse had occurred after 2010, when the law was reformed, another would be the resolution of the Brazilian Justice.
