While this Thursday the Senate discusses Javier Milei's flagship DNU to reform the State and defines its validity, the question that arises is
what will happen next
, whether it is voted in favor or against in the chamber.
The Decree of Necessity and Urgency No. 70/2023, formally called "Bases for the reconstruction of the Argentine Economy" and signed by the President on December 20,
modifies, replaces or repeals more than one hundred laws or decrees
, including the Rental Law, the Employment Contracts Law and the increases in prepaid medicine.
Although the Senate can
approve
the DNU, which would imply that the rule dictated by Milei takes
full effect
, its
rejection would not invalidate its effects
.
According to Law 26,122, which determines the legal regime for presidential decrees to cease to be in force, a DNU
must be rejected by both chambers
.
So, if there is
a negative vote in the Senate , the
Chamber of Deputies
will have the last word
.
To endorse the proposal, the Government highlighted in advance that
Congress has never rejected a DNU
in the 40 years of democracy, that is, that both legislative chambers have voted against it to cancel it.
Nor was there a measure so ambitious and comprehensive that it would impact so many laws at the same time.
Regarding the procedure, both deputies and senators must
treat the decrees as a whole
, that is,
they cannot introduce modifications
, make corrections or incorporate new articles that had not been included in the original text.
In addition, both approval and rejection must be made
with the majority of each precinct
.
The DNU came into force on December 29, 2023, that is, eight days after its publication in the Official Gazette, which was on December 21.
Since then, many questions have been raised about its validity, largely due to the large number of topics it contains.
